GENERAL TERMS AND CONDITIONS ONLINESHOP(AGB)

1. General information

These General Terms and Conditions (GTC) govern all legal relationships for purchase contracts concluded between TREMP Plastic Surgery AG (seller) and its customers (buyers), whether in the online store (online store), by e-mail or telephone. Any provisions of the Buyer that conflict with these GTC are hereby expressly excluded.

2. Contractual partner

3. Offer and delivery

  • The offer can be viewed on the website https://tremp.swiss and is non-binding. Product information is mainly for illustrative purposes and is non-binding. Prices, product ranges and technical specifications are subject to change without notice. The offers are only valid as long as they are visible on the website and while stocks last.

4. Order process/conclusion of contract

The order is placed in the following steps:

(a) Selection of the desired goods

(b) Confirm by clicking on the "Add to shopping cart" field

(c) Check the details in the shopping cart

(d) Confirm by clicking on the "Checkout" field

(f) Selecting the payment method and entering the buyer's details

(g) Re-check or correct the respective data entered

(h) Binding transmission of the order, payment and acceptance of the GTC by clicking on the "Order with obligation to pay" field.

5. Prices, shipping costs and payment

  • Prices are quoted in Swiss francs (CHF), including statutory value added tax (currently 8.1%). The published prices and conditions are subject to change, whereby the effective date is the date of the order by the buyer.

  • The shipping costs are owed in addition and vary depending on the destination and shipping method. The shipping costs the transportation and packaging of the ordered goods to the specified delivery address. note that customs duties and taxes for parcels are the responsibility of the buyer. The shipping costs incurred will be displayed during the ordering process and may be subject to change.

  • Deliveries to countries outside the EU may be subject to additional duties, taxes or fees. These are not levied by the supplier, but must be paid to the local customs or tax authorities. It is recommended that you obtain information from the relevant authorities before ordering.

  • Payment for the ordered goods is made in advance, either by credit card via PayPal, Twint or by prepayment [alternatively also by invoice]. In the case of online payments, the value of the goods will be debited on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without giving reasons. Invoices are payable within 20 days of receipt. The seller reserves the right to charge reminder fees of at least CHF 20 and further collection fees after the second reminder. Assignment to a debt collection agency remains reserved.

  • When paying by credit card, the contractual and data protection provisions of PayPal apply (http://www.paypal.com/ch/home).

  • The delivered goods remain the property of the seller until full payment has been made. The seller is entitled to make a corresponding entry in the retention of title register. the buyer defaults on payment of the purchase price, the seller is entitled, among other things, to withdraw from the contract and take possession of the goods again.

6. Worldwide orders and deliveries

The seller delivers worldwide. Delivery times may vary depending on the destination and are specified during the ordering process. If customs duties, import taxes or similar charges are incurred as a result of shipping abroad, the buyer shall bear these costs. If deliveries are delayed or prevented due to force majeure or other unforeseeable, exceptional circumstances, the seller shall be released from the obligation to deliver for the duration of the hindrance.

7. Warranty and liability

Complaints due to defects or due to incomplete or incorrect delivery must be notified to the seller in writing immediately, at the latest 5 days from the date of delivery. Hidden defects must be reported to the seller in writing immediately, but no later than 5 days after discovery. If the Buyer fails to notify the Seller in good time, his claims shall lapse. After returning the rejected goods, the Buyer shall receive a replacement delivery in the event of a defect. If no replacement delivery is possible, the seller shall refund the payment made. In addition, any claim for reduction, rescission or compensation for consequential damages is excluded to the extent permitted by law.

The buyer shall forfeit any warranty rights in the event of improper use of the goods. Defects resulting from normal wear and tear or as a result of improper handling or damage by the buyer or third parties, as well as defects attributable to external circumstances (improper storage, frost, heat, moisture, incorrect storage, etc.), do not entitle the buyer to withdraw from the contract or to replace the goods. The vendor accepts no liability for this. Goods returned at the expense and risk of the buyer. The products must be properly packed in the original packaging and sent by registered mail. If the Seller is unable to identify any defects that are covered by the warranty or fall under the manufacturer's guarantee, the Seller may charge the Buyer for the costs of inspecting and shipping the goods.

Other claims of the Buyer - irrespective of the legal grounds - are excluded to the extent permitted by law. The Seller, its auxiliary persons and any vicarious agents shall not be liable for damages that have not occurred to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses of the Buyer. Any liability of the seller in connection with the liability for defects in the offer (in particular incorrect illustrations, texts and prices) and the delivery is excluded to the extent permitted by law.

Products ordered by the buyer by mistake will neither be taken back nor refunded.

8. Cancellation, right of return and withdrawal of the buyer

Orders placed by the buyer are binding and the customer is obliged to accept the service. Subsequent changes at the customer's request are possible at the seller's discretion. The buyer has the right to return the goods within 14 days of receipt and to revoke the contract. The right of return can only be exercised with legal effect if the goods are returned unused, undamaged, complete and in their original packaging by registered mail. Upon receipt of the goods returned in the condition described, the seller shall refund the value of the goods to the buyer. The goods are to be returned at the expense, benefit and risk of the buyer.

9. Copyrights

All texts, images, graphics, video and animation files are subject to copyright and other laws for the protection of intellectual property. They may not be copied, modified or used on other websites without the consent of the seller.

10. Data protection

The current version of the seller's privacy policy, which is available at https://tremp.swiss, applies.

The seller may send the customer information about other products or services of the seller (e.g. in the form of a newsletter or by letter). If the customer no longer wishes to receive such communications from the seller, he can unsubscribe at any time by e-mail to dr.tremp@hin.ch, by letter or by telephone using the contact details provided at www.tremp-plastic-surgery.com.

11. Applicable law and place of jurisdiction

The Seller expressly reserves the right to amend these GTC at any time and to apply them immediately. The amended GTC shall enter into force upon publication on of the website in force.

All contracts concluded with the seller are subject to Swiss law, to the exclusion of the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). In the case of orders placed by private individuals for private use, the place of jurisdiction shall be governed by the consumer protection provisions. In all other cases, the Canton of Zug is the exclusive place of jurisdiction.

12. Severability clause

Should any provision of these GTC be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the statutory provision.
